Each pilot remains solely and fully responsible for ensuring that all documents submitted through the Balloon Pilot Data Port are current, accurate, complete, and compliant with all applicable federal, state, and local laws, regulations, and requirements. The Federal Aviation Administration (FAA) is the final authority and sole arbitrator regarding the legality, validity, and acceptability of any aviation-related document, credential, or record.
Event organizers are responsible for establishing documentation requirements and submission deadlines and for ensuring that pilots submit all required documentation in a timely manner. Review or acceptance of documents through the Balloon Pilot Data Port does not constitute legal approval, regulatory approval, or FAA authorization.
The Balloon Pilot Data Port is operated by Ken Tuley. Neither Ken Tuley nor the Balloon Pilot Data Port assumes any responsibility or liability for a pilot’s failure to comply with applicable laws, regulations, or event requirements, regardless of whether documents have been reviewed, accepted, or flagged within the system.
By submitting documents through the Balloon Pilot Data Port, each pilot and event organizer agrees to indemnify, defend, and hold harmless Ken Tuley and the Balloon Pilot Data Port from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
the submission, use, or reliance upon any document provided through the Balloon Pilot Data Port;
any inaccurate, incomplete, expired, or non-compliant documentation;
any violation of applicable laws, regulations, or event requirements.
